Suffolk County Traffic Agency Criminal Appeals

After a nonjury trial, most New York traffic adjudications result in a finding of guilt but what of the motorist that wishes to appeal? In Suffolk County, New York? Traffic or Car Accident? Issued a ticket? You may find that the Suffolk County Traffic Judge does not agree with your version of events and you need an appellate attorney but what if the New York Traffic Court does not want to comply with providing the traffic paperwork necessary for the motorist to pursue an appeal in a higher (or an actual) court of law?


Suffolk County Traffic Accident or Suffolk County Traffic Infraction - It is the Traffic Agency, the Suffolk County Traffic and Parking Violations Agency ("TPVA"), where some people first encounter law enforcement after an accident or a traffic stops. If convicted, it is the Appellate Court: Second Department Appellate Term that one must pursue justice for an unlawful traffic conviction or for an error made by the Suffolk County Traffic Agency or Suffolk County Judge as a matter of law.


Of the appeal, the Suffolk County Traffic Agency, or the Suffolk TPVA, is directed:

Motion by appellant on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered September 21, 2022, for an extension of time to perfect the appeal and to compel the Agency to file its return as well as the affidavit of errors.

The Case is People v. RETAMOZZO, 2024 NY Slip Op 65465 - NY: Appellate Term, 2nd Dept., 2024, and the Appellate Court, among other things, orders "on the court's own motion, that the Agency is directed to accept the timely filed affidavit of errors; and it is further, ORDERED that the branch of appellant's motion to compel the Agency to file the court's return on the affidavit of errors is granted and the return shall be filed within 15 days of the date of this Decision & Order on Motion..."
